Incorporated Societies Act Update for Waka Ama Clubs and Regions

As you may be aware, the new Incorporated Societies Act 2022 was passed into law last year. The new legislation modernises the rules governing New Zealand’s incorporated societies for the first time since 1908. The plan is for Waka Ama NZ to roll out an approach that will help all of our clubs collectively to work through these changes and we will provide as much support as possible.

As a result of the new act, there are some significant changes in the requirements around membership, governance, general meetings, dispute resolution, winding up, financial reporting and auditing have been made.

There is a transition period during which incorporated societies will continue to be subject to the 1908 Act until they decide whether they wish to re-register under the 2022 Act or consider alternative options. 

Re-registration will involve filing a constitution that is compliant with the new Act.  There is no need to rush into the re-registration process as you have until April 2026.  Societies continue to operate under the current 1908 Act until they are ready to re-register under the 2022 Act

Waka Ama NZ Approach
The plan is for Waka Ama NZ to roll out an approach that will help all of our clubs collectively and we will provide as much support as possible.

At this stage, we are waiting on Sport NZ to provide WANZ with further guidance and a template that can be used to ensure this process is as easy as possible.

There are changes in the act that will affect WANZ as an NSO, our Regional bodies and our clubs. Sport NZ has advised that we start the review from the top (WANZ) and then work through with our regions and clubs. The templates and resources from Sport NZ are due at an NSO level in the first part of October, followed by regions and clubs in November.

We are advising our waka ama whānau to hold fire until we have all the information and templates available as this will make the process much more seamless for our clubs and regions.
